Food Pantry Waiver and Release of Liability
By accessing and accepting food items from the Mercy College of Ohio Food Pantry, I acknowledge and agree to the following:
- Voluntary Participation: I am voluntarily accepting food items from the pantry. My participation does not affect my enrollment status, financial aid, or any other rights as a student.
- Nature of Items: Food items are donated and provided 'as is,' without warranties regarding quality, safety, or expiration dates. I am responsible for inspecting items before consumption.
- Release and Hold Harmless: To the fullest extent permitted by law, and in consideration of the donated goods, I, for myself and my heirs, release and hold harmless Mercy College of Ohio, its officers, employees, volunteers, donors, and food suppliers from any liability for illness, injury, or damages arising from the use or consumption of pantry items, except in cases of gross negligence or intentional misconduct.
- This release includes, but is not limited to, any and all claims related to:
- The quality, condition, or packaging of the food.
- Any illness, injury, or damage resulting from the consumption or use of these items.
- Any claims arising from my use of the pantry facilities.
- Legal Protections: I understand that food donations and distributions are protected under the Ohio Good Samaritan Food Donation Act (ORC §2305.37) and the federal Bill Emerson Good Samaritan Food Donation Act (42 U.S.C. §1791).
- Non-Discrimination: The pantry is operated in compliance with applicable federal and state nondiscrimination laws.
